Terms of Use

We publish market research and commentary of general circulation. We are not your investment adviser, broker, or fiduciary. Nothing in the Services is an offer to buy or sell any security, or personalized investment, tax, or legal advice. The Disclaimer page is part of these Terms.

We grant you a limited, revocable, non-exclusive, non-transferable license to access the Services for your own personal, non-commercial use. You do not acquire any ownership of the content, the data, the charts, or the name Confluent Research.

If you want reprint rights, ask. Silence is not permission.

The email list is hosted by Beehiiv. Subscribe only with an address you control. You may unsubscribe at any time. Login, register, and any future paid product, if we add them, are extra contracts. Until we ship a paid product, a subscribe is not a client relationship and not a paid advisory mandate.

We may refuse, suspend, or cancel access if you break these Terms or abuse the Services.

Historical returns, volatility, histograms, allocation bands, household examples, and any “work we actually run” description are illustrations and sample statistics. They are not a forecast, not a composite, and not your portfolio. Assumptions will be stated when we show an example. Change the assumptions and the number changes. Past performance does not indicate future results. You can lose money.

We do not determine suitability for you. If you need advice that fits a household, hire someone who will take that duty.

We use public and vendor data we believe is reliable, including long market histories. We do not warrant that any figure is complete, current, or free of error. We have no duty to update an old post. If we correct a material error we will say so. You rely on the work at your own risk.

We may hold, buy, or sell securities we write about. Assume we have a view. Do not assume we will tell you when it changes. We do not accept payment from issuers to publish a name. If that ever changes, we will disclose it on the piece.

Do not use the Services to break the law, probe or overload the site, harvest addresses, or impersonate us. Comments or emails you send may be used to operate and improve the Services. Do not send us material you do not have the right to send.

The Services are provided “as is” and “as available.” To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the site or the list will be uninterrupted or secure.

To the fullest extent the law allows, Confluent Research and its owners, editors, and suppliers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of capital, data, or profits, arising out of your use of the Services or your reliance on any content, even if we were told that kind of loss was possible.

Our total liability for any claim arising out of the Services is limited to the amount you paid us for the Services in the twelve months before the claim, or fifty dollars, whichever is greater. If you paid us nothing, that cap is fifty dollars.

Some states do not allow certain limits. If you are in one of them, some of this section may not apply to you.

You will indemnify and hold us harmless from claims, damages, and costs (including reasonable attorneys’ fees) that arise out of your misuse of the Services or your breach of these Terms.

The Privacy Policy describes how we handle addresses and site data. It is part of these Terms.

We may change the Services or these Terms. The “Last updated” date will change. Continued use after a change is acceptance. If you do not accept a change, stop using the Services and leave the list.

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law rules. Courts in New Hampshire have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect the work.

If a court strikes one clause, the rest still stands. These Terms are the entire agreement for use of the Services. They do not create a partnership, advisory contract, or fiduciary duty. A waiver on one occasion is not a waiver the next time.
